These Terms of Service ("Terms") govern your use of The Project Desk website and services. By accessing or using our website, you agree to these Terms.

The Project Desk is a brand operated by Bedrock Growth Systems LLC ("we," "us," or "our").

These Terms apply to everyone who uses our website, including both homeowners and home-service businesses. Where a section applies to only one of those audiences, it says so.

1. Overview of Services

The Project Desk connects homeowners with independent local contractors for home improvement and remodeling services. We do not perform construction services and are not a contractor.

Our role is to qualify homeowner project requests, match them with an appropriate contractor, and coordinate the resulting appointment. We do not perform, supervise, price, or warrant the underlying home improvement work.

We also operate programs for home-service businesses. These currently include the Referral Partner Network, through which a business may refer homeowner projects it does not handle and may earn a referral reward, and a contractor network through which a business may receive homeowner appointments for the services it wants. Participation in either program is subject to a separate agreement, as described in Section 5.

A note on the word "Partner." Used on its own in these Terms, in our Privacy Policy, in our SMS Terms, and in the consent language shown to homeowners, "Partner" means a contractor that receives a homeowner's information (see Partner List). A "Referral Partner" is a different role: a business that sends homeowner projects to The Project Desk. Enrollment as a Referral Partner does not make a business a "Partner" in the first sense, and does not entitle it to receive homeowner information.

2. No Guarantee of Services

We do not guarantee:

  • That you will be matched with a contractor
  • The availability, quality, or pricing of any contractor
  • That any project will be completed

All services are provided directly by independent contractors. We encourage users to independently verify any contractor's licensing, insurance, and qualifications before engaging their services.

3. Independent Contractors

Contractors in our network are independent businesses and are not employees, agents, or representatives of The Project Desk.

We do not control, supervise, or direct the work performed by any contractor and are not responsible for:

  • The performance or quality of services
  • Project outcomes
  • Contractor communications or conduct

Any agreement for services is solely between you and the contractor.

Users are solely responsible for evaluating and selecting any contractor they choose to work with. We encourage homeowners to verify licensing, insurance coverage, and other qualifications directly with the contractor before entering into any agreement.

The Project Desk and Bedrock Growth Systems LLC are not a party to any agreement, contract, or arrangement between a homeowner and a contractor. We do not handle payments for the contractor's home improvement work, and we do not provide project management or dispute resolution for that work. We have no responsibility for any agreements or services provided by contractors.

This does not apply to amounts owed to or by The Project Desk under a contractor program. Appointment charges payable by a participating contractor, and referral rewards payable to a Referral Partner, are handled by The Project Desk under the applicable program agreement described in Section 5. Those amounts are separate from, and are not a percentage of, any contract between a homeowner and a contractor.

4. User Responsibilities

By using our services, you agree to:

  • Provide accurate and truthful information
  • Not submit false, misleading, or duplicate requests
  • Not misuse the website or attempt to interfere with its operation, including through automated means or unauthorized access

a) Homeowners

  • Use the service for legitimate home service inquiries only
  • Submit requests only if you are the homeowner or otherwise authorized to request home improvement services for the property

b) Business Users

If you use our website on behalf of a home-service business, you additionally agree that:

  • You are authorized to submit information on behalf of the company you identify
  • You will not submit a homeowner's personal information unless that homeowner has authorized you to share it with The Project Desk for the purpose of being contacted about their project
  • You will comply with all laws applicable to how you obtain and share that information, including privacy, telemarketing, and consumer-protection laws
  • You will not represent yourself as an employee, agent, or authorized spokesperson of The Project Desk, or make guarantees about contractors, pricing, or project outcomes on our behalf
  • You are responsible for maintaining any licensing, registration, bonding, and insurance required for the work your company performs

These obligations are in addition to, and do not replace, the terms of any program agreement described in Section 5.

5. Contractor Program Agreements

Participation in a program for home-service businesses is governed by a separate agreement in addition to these Terms:

  • The Referral Partner Network is governed by the Referral Partner Terms and the Referral Reward Schedule.
  • Receiving homeowner appointments is governed by the contractor agreement and appointment rules provided to your company. Appointment pricing and the applicable qualification, credit, and cancellation rules are established per account and disclosed before your company begins receiving appointments.

Submitting a form on this website does not by itself enroll your company in a program or entitle it to receive referrals, appointments, rewards, or payment. Enrollment and approval are governed by the applicable program agreement.

Order of precedence. These Terms govern your use of this website. Where a program agreement conflicts with these Terms as to that program, the program agreement controls for matters within its scope. These Terms continue to apply to your use of the website generally, and to any matter the program agreement does not address.

6. Communications & SMS Terms

a) Consent

Homeowners — phone and email. By submitting your information, you authorize The Project Desk and selected local contractors participating in your request (see Partner List) to contact you by phone and email regarding your request and related home improvement services.

Text messaging is separate. Consent to receive text messages, including messages sent using automated technology, arises only when you affirmatively check the applicable SMS consent box on our form. It does not arise from submitting a form on its own. Each SMS consent is optional, is never pre-checked, and is not a condition of any purchase, estimate, or participation in any program. Marketing text messages require their own separate consent.

Business users. By submitting a contractor program form, you authorize The Project Desk to contact you by phone and email regarding your request and, if approved, your company's participation in that program. Text messaging to business contacts requires a separate, optional consent and is never a condition of participation. Our SMS Terms describe each messaging category.

b) SMS Program

Our SMS messaging serves two distinct audiences — homeowners and business users — and each category has its own consent. Business users participating in a contractor program may separately consent to non-marketing operational messages about that program, including referral status, reward and payout notices, appointment coordination, account administration, and billing. Those messages are sent by The Project Desk only, and their frequency is ongoing rather than limited to a single request.

Our SMS Terms describe every category, its consent, and its frequency in full, and control in the event of any inconsistency with this summary. The homeowner categories are:

  • Informational & Transactional Messages: By checking the SMS consent checkbox on our form, you agree to receive automated informational and transactional text messages from The Project Desk and the specific service provider(s) matched to your request, including estimate request confirmations, appointment scheduling coordination, contractor introduction notifications, and project status updates.
  • Marketing & Promotional Messages: If you separately check the marketing consent checkbox, you also agree to receive automated marketing and promotional text messages from The Project Desk, which may include special offers, seasonal service reminders, and information about additional home improvement services. Marketing messages are sent only by The Project Desk. Consent to receive marketing messages is separate from, and not required for, informational and transactional messaging or any other service.

c) SMS Specific Terms

  • You must be 18 years of age or older to use this SMS service.
  • Opt-Out: You may opt out of text messages at any time by replying "STOP" to any message. Replying STOP will unsubscribe you from all text messages sent by The Project Desk, including both informational/transactional and marketing messages. After you send "STOP" we will send one final SMS to confirm you have been unsubscribed. You will no longer receive SMS messages from The Project Desk unless you subsequently opt in again or otherwise provide new legally sufficient SMS consent.
  • Assistance: If you are experiencing issues with the messaging program, reply HELP for assistance or contact us at info@theprojectdesk.com.
  • Rates & Frequency: Message and data rates may apply. Message frequency varies based on your interaction with our services and contractors.
  • No Condition of Service: Consent to receive automated text messages, calls, or emails is not a condition of purchase or receiving an estimate.
  • Carrier Liability: Carriers are not liable for delayed or undelivered messages.

d) Email

You may opt out of marketing and promotional email at any time by using the unsubscribe link in our emails or by contacting us at info@theprojectdesk.com.

Transactional and operational email is not marketing and is not covered by that opt-out. We may continue to send messages necessary to provide a service you requested or to administer a relationship you have with us — for example estimate and appointment confirmations, referral and reward notices, invoices and payment records, tax documentation, security and compliance notices, and changes to these Terms or the agreements governing your participation. To stop those, discontinue the applicable service or program.

7. Limitation of Liability

To the maximum extent permitted by law, The Project Desk and Bedrock Growth Systems LLC shall not be liable for any damages arising from:

  • Services provided by contractors
  • Errors or omissions by contractors
  • Delays, project outcomes, or disputes
  • Any indirect, incidental, or consequential damages

Your sole remedy is to address any issues directly with the contractor.

8. Indemnification

You agree to indemnify, defend, and hold harmless The Project Desk and Bedrock Growth Systems LLC, and their respective owners, officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • Your use of our website or services
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Any agreements or interactions between you and a contractor

9. No Warranty

Our services are provided "as is" and "as available" without warranties of any kind, express or implied.

10. Website Content Disclaimer

Content on our website, including blog posts, articles, guides, and other informational materials, is provided for general informational purposes only and does not constitute professional, construction, engineering, legal, or financial advice. While we strive for accuracy, we make no representations or warranties regarding the completeness, accuracy, or timeliness of any content on our website, and we are not liable for any actions taken in reliance on such content. Always consult a qualified, licensed professional regarding your specific project and verify local permit and building code requirements before beginning any home improvement work.

11. Intellectual Property

All content on this website, including text, graphics, logos, images, and design elements, is owned by or licensed to The Project Desk, a brand operated by Bedrock Growth Systems LLC, and is protected by applicable copyright and intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any content on this website without our prior written permission.

12. Third-Party Services

We may use third-party tools and platforms to operate our services. We are not responsible for the performance or practices of these third parties.

13. Privacy

Your use of our services is also governed by our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.

15. Dispute Resolution, Arbitration, and Class Action Waiver

Program agreements are carved out of this Section. If a dispute arises out of or relates to a contractor program described in Section 5, and the agreement governing that program contains its own dispute resolution, forum, venue, jury waiver, or class action provisions, those provisions govern that dispute in place of this Section 15 in its entirety, including the arbitration requirement. This Section 15 applies to that dispute only to the extent the program agreement is silent. Nothing in this Section 15 requires a Referral Partner or a participating contractor to arbitrate a dispute that its program agreement commits to a court.

a) Informal Resolution

In the event of any dispute arising out of or relating to these Terms, our services, or your use of our website, you agree to first contact us at info@theprojectdesk.com and attempt in good faith to resolve the matter informally for at least thirty (30) days before initiating arbitration or any legal proceeding.

b) Binding Arbitration

If a dispute is not resolved informally, you and The Project Desk (including Bedrock Growth Systems LLC) agree that any dispute, claim, or controversy arising out of or relating to these Terms, our services, our website, or communications you receive from us or contractors participating in your request — including any claims under the Telephone Consumer Protection Act (TCPA) or similar state laws — shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Colorado or, at your election, by remote means such as telephone or videoconference. Judgment on the arbitration award may be entered in any court having jurisdiction.

c) Class Action Waiver

YOU AND THE PROJECT DESK AGREE THAT ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims of more than one person and may not preside over any form of class or representative proceeding. If this class action waiver is found to be unenforceable as to a particular claim, then that claim (and only that claim) shall proceed in court rather than arbitration.

d) Exceptions

Either party may bring an individual claim in small claims court in lieu of arbitration, and either party may seek injunctive relief in court to protect its intellectual property rights.

e) Governing Law

These Terms shall be governed by the Federal Arbitration Act with respect to arbitration and otherwise by the laws of the State of Colorado, without regard to conflict of law principles. Any dispute not subject to arbitration shall be brought exclusively in the appropriate state or federal courts located in Colorado, and you consent to the personal jurisdiction of those courts.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
